Terms of Service

These Terms of Service ("Terms") govern your use of paymentoperators.com (the "Site") and any course, community, download, or other content offered by Payment Operators, LLC, a New Hampshire limited liability company ("Payment Operators," "we," "us"). By creating an account, opting in, or making a purchase, you agree to these Terms.

1. What we provide

Payment Operators provides training on how card payments work and a methodology for prospecting and winning merchants, together with tools and support for putting that methodology into practice. Depending on what you purchase, this may include the Payment Operators course; access to a customer relationship management (CRM) tool; marketing materials, cheat sheets, and scripts; virtual assistant (VA) support; demo support; hardware logistics support; access to multiple POS systems and software products; a mentor for field support; weekly group coaching calls; a free playbook; and related emails and community spaces. We call the CRM, VA support, demo support, hardware logistics support, POS and software access, mentoring, and coaching calls the "Support Services," and everything we provide, including the Support Services, the "Content." The Content is education and support only. It is not legal, tax, accounting, financial, or investment advice, and it does not create an attorney-client relationship with anyone, including Robert Fojo. Consult your own counsel before signing any agreement.

2. No accounts, territories, or employment

We do not sell, assign, or guarantee merchant accounts, territories, or locations. Any prospect lists you build, including with the CRM or VA support, are for your own outreach. We are not an independent sales organization (ISO), processor, or employer, and we do not purchase residuals or anything else you produce. Any agreement you sign with an ISO, processor, or other company is solely between you and that company.

3. Earnings

We make no representation about what you will earn. The training, tools, and support we provide do not guarantee any result; success depends on your own execution, including your effort, skill, market, and the agreements you sign. Our Earnings Disclaimer is part of these Terms.

4. Accounts

You must be at least 18 years old and provide accurate information. You are responsible for keeping your login credentials confidential and for all activity under your account.

5. License and access

When you purchase a course, we grant you a personal, non-exclusive, non-transferable, revocable license to access the Content for your own individual use for the life of the program, as described in Section 6. You may not share your login; copy, resell, record, or redistribute the Content; or use it to create a competing course or product. You may use the marketing materials, cheat sheets, and scripts in your own merchant services business.

6. Support Services

  • Lifetime access. Course access and Support Services last for the life of the program, meaning for as long as we offer it. If we discontinue the program, we will give you at least 30 days' notice by email.
  • Coaching calls. Group coaching calls are held weekly on a schedule we publish. We may occasionally reschedule or cancel a call. Calls may be recorded and shared with other students, so do not disclose merchant account numbers, pricing you are not permitted to share, or other confidential information on a call.
  • Mentor. Your mentor provides guidance on applying the methodology in the field. Mentors are not your employer, agent, or business partner, are not affiliated with your ISO or processor, and are not responsible for the outcome of any deal. Mentoring is scheduled based on reasonable availability.
  • VA support. VA support covers the administrative and outreach tasks described in the program. You are responsible for reviewing and approving anything sent or done in your name and for complying with laws that apply to your outreach, including telemarketing, text-message, and email rules such as the TCPA and CAN-SPAM Act.
  • Demo support. We help you prepare for and run product demonstrations for merchants. You remain responsible for what you represent to a merchant about pricing, terms, and products.
  • Hardware logistics support. We help coordinate ordering, shipping, and setup of POS and terminal hardware. Hardware is supplied and priced by your ISO, processor, or vendor, and we are not responsible for hardware cost, availability, defects, or carrier delays.
  • POS and software access. We give you access to multiple POS systems and software products so you can serve merchants across many verticals. Product availability, pricing, approval, and terms are set by each provider and may change.
  • CRM. The CRM may be operated by a third-party provider and subject to its terms. You are responsible for the data you enter and for using it lawfully. Export any data you want to keep before your access ends for any reason.
  • Changes. We may change the format, schedule, providers, or personnel for any Support Service, and will give reasonable notice of material changes.

7. Payment

Prices are listed on the sales page in U.S. dollars. If you choose a payment plan, you authorize us and our payment processor to charge your payment method on each scheduled date until the plan is paid in full. If a plan payment fails and is not cured within 7 days, we may suspend access until the balance is paid. You remain responsible for the full purchase price under any payment plan.

8. Refunds and the First-Deal Rebate

All sales are final, except as described in our Refund Policy, which includes the $250 First-Deal Rebate and is part of these Terms. Filing a chargeback instead of contacting us first is a breach of these Terms, and we may terminate your access.

9. Community and conduct

In any community, comment area, coaching call, or mentoring session, you agree not to post unlawful, harassing, or misleading content; solicit other members for business opportunities without permission; share other members' information; or misrepresent your relationship with Payment Operators. We may remove content or terminate access for violations.

10. Intellectual property

All Content, trademarks, and materials on the Site are owned by Payment Operators, LLC or its licensors and are protected by copyright and other laws. Nothing in these Terms transfers ownership to you.

11. Disclaimer of warranties

The Site and Content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Industry rules, card brand rules, and laws (including those on surcharging and cash discounting) change; you are responsible for confirming current requirements before relying on any Content.

12. Limitation of liability

To the fullest extent permitted by law, Payment Operators and its members, managers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or residuals. Our total liability for any claim relating to the Site or Content will not exceed the amount you paid us in the 12 months before the claim.

13. Indemnification

You agree to indemnify and hold harmless Payment Operators from claims arising out of your use of the Content, your merchant services business, or your breach of these Terms.

14. Termination

We may suspend or terminate your access, including to Support Services, for breach of these Terms. Sections 2, 3, 10 through 13, and 15 survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Hillsborough County, New Hampshire, and you consent to their jurisdiction.

16. Changes

We may update these Terms by posting a new version on the Site with a new "Last updated" date. Changes apply to purchases and use after the posting date.
